Peak Time Rewards ® Program Terms & Conditions

The Program:

  • I am agreeing to participate in the Ameren Illinois Peak Time Rewards program (the “Program”), which has been implemented pursuant to an Ameren Illinois tariff approved by the Illinois Commerce Commission. Information on the tariff is under Rider PTR, available at AmerenIllinois.com. I agree to these terms and conditions (including the terms of Rider PTR now in effect and as may be amended from time to time, and the PeakTimeRewards.com Website Privacy Statement available at peaktimerewards.com/legal-info/).
  • I understand that as a participant in the Program, I will receive a credit on my bill only if I reduce my energy usage below an established baseline of energy usage during a Peak Time Rewards Event. I understand that credit amounts may be based on estimated electricity usage and can be found on my Ameren Illinois online account.
  • I understand that if I enroll in the Program after March 1 this year, my account will be placed on a waitlist then added as a participating customer as openings become available.
  • I understand that the Advanced Meter Infrastructure (AMI) meter installed at my premises as a condition of enrollment in the Program must be set by Ameren Illinois for wireless meter reading, and that Ameren Illinois must have unrestricted access to the meter during business hours.

Notifications:

  • I acknowledge I must provide at least one working phone number or email address (each a “notification method”) to remain enrolled in the Program.
  • I acknowledge that, depending on the notification method I choose, usage and data fees from my cellular phone carrier may apply based on my plan with my carrier.
  • Should I choose to receive text messages as a notification method, I acknowledge that:
    • I will receive an initial text message asking me to opt in. To receive text notifications, I must reply YES. To opt out of text messages, I can reply STOP. For additional information I can text HELP. I will receive approximately 2 messages per month from 79037.
    • Elevate Energy is able to deliver messages to the following mobile phone carriers: AT&T, Verizon Wireless, Sprint, T-Mobile (which will not be liable for delayed or undelivered messages), U.S. Cellular, Alltel, Boost Mobile, Nextel, Metro PCS and Virgin Mobile, Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central IL (ECIT), Cellular One of Northeast Pennsylvania, Cincinnati Bell Wireless, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless).

Program Administration:

  • I acknowledge that Ameren Illinois contracted with Elevate Energy to administer the Program.
  • I authorize Ameren Illinois to release my account information and all other information permitted by law to Elevate Energy. I understand that Elevate Energy will keep my account information confidential and will use this information only to operate, market, and improve the Program and to evaluate consumer and system benefits.

Peak Time Rewards Website Terms & Conditions

By using the Website, you signify your assent to be bound by the following terms and conditions. If you do not agree with any part of the following terms and conditions, you must not use the Website.

  1. OWNERSHIP. Except for items in the public domain, the information and all other materials comprising the Website (collectively, the “Materials”), are wholly owned by (or licensed to) Elevate Energy and/or its content providers. The Website contains copyrighted material, trademarks, and other proprietary information. Elevate Energy owns a copyright in the selection, coordination and arrangement of the Website. Nothing contained on this Website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any of the Materials without the written permission of Elevate Energy or such other party that may own the Materials.
  2. USE OF WEBSITE. Except for your non-commercial personal use, the Website may not, in whole or in part, be sold, reproduced, published or redistributed in any medium, directly or indirectly, for any commercial or non-commercial purpose. Unauthorized use of the Website and/or the Materials may violate applicable intellectual property laws or other laws. You must retain all copyright and trademark notices, including any other proprietary notices, contained in the materials. The use of such materials on any other website or in any environment of networked computers is prohibited. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, pornographic or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law.

By uploading or otherwise submitting a file or other information (”Contribution”) to the Website, you automatically grant, or warrant that the copyright owner of the Contribution has expressly granted, to Elevate Energy a perpetual, royalty-free, irrevocable, worldwide, non-exclusive license to use, reproduce, publicly display, modify, store, create derivative works from, and/or distribute the Contribution (in whole or part) and/or to incorporate it in other works in any medium now known or hereafter developed, as if the Contribution were public domain information. You similarly permit any Internet user to download, store, manipulate, view, print and display the Contribution for that user’s personal use.

  1. AGE AND RESPONSIBILITY. You represent that you are of sufficient legal age to use the Website and to create binding legal obligations for any liability you may incur as a result of the use of the Website. You understand that you are financially responsible for all uses of the Website by you and those using your login information.
  2. ACCOUNT ACCESS. You agree that you are solely responsible for maintaining the integrity of your online account access UserID and Password. You further agree to only establish online account access for your own account(s) or for those accounts to which you have been granted expressed permission to access. Elevate Energy is not liable for damages or losses incurred by either the account owner or the user in the event that a user establishes account access to an account which is not his/hers and for which he/she has not been granted permission to access by the account owner.
  3. PRIVACY. You have read the Elevate Energy Privacy Policy, the terms of which are incorporated herein, and agree that the terms of such policy are reasonable. You consent to the use of your personal information by Elevate Energy and/or its third party providers and distributors in accordance with the terms of and for the purposes set forth in Elevate Energy Privacy Policy.
  4. NO WARRANTIES AND LIMITATION OF LIABILITY. Your use of the Website is at your sole risk. You assume full responsibility and risk of loss resulting from the downloading and/or use of files, data or other material (including software) obtained through the Website. Elevate Energy strives to ensure the accuracy of the information presented on the Website, however due to various circumstances, including, but not limited to, delays caused by postal handling, upgrades and/or changes to AIC’s bill and payment processing system there may be variances between the information available on the Website and your actual bill and payment information, energy usage history or other statistical data. For this reason, neither Elevate Energy nor any of its affiliates, subsidiaries, business units, content providers can guarantee the accuracy, truthfulness or reliability of any information provided on or by means of the Website.

THE WEBSITE AND THE CONTENT PROVIDED THEREON IS PROVIDED “AS IS”, AND NEITHER Elevate Energy, AIC NOR ANY OF THEIR AFFILIATES, SUBSIDIARIES, BUSINESS UNITS, SUPPLIERS, CONTENT PROVIDERS, CONTRACTORS, LICENSORS, EMPLOYEES, AGENTS, OR THE LIKE MAKES ANY EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES REGARDING THE USABILITY, CONDITION OR OPERATION THEREOF. For further clarity, in all events, Elevate Energy, AIC and all of their affiliates, subsidiaries, business units, content providers, agents and the like shall not be liable for the defamatory, offensive, or illegal conduct of other users of the Internet. Some jurisdictions do not allow implied warranties to be excluded or modified or liability to be limited, so not all of the above limitations may apply to you.

The provisions of this Section 6 and Section 5 above represent a reasonable allocation of the risks under this Agreement. Elevate Energy’s willingness to allow you to use the Website reflects this allocation of risk and the limitations of liability specified herein.

  1. INDEMNIFICATION. You agree to indemnify Elevate Energy, AIC and all of their affiliates, subsidiaries, business units, content providers, contractors, agents and the like, in each instance from and against any and all claims, suits, liabilities, expenses (including, without limitation, attorneys’ fees), and/or damages arising out of claims based upon your use of the Website including, without limitation, any claim of libel, defamation, violation of legal rights of others (including rights of privacy or publicity), loss of service by other subscribers and/or infringement of intellectual property or other rights.

Elevate Energy does not control such websites and is not responsible for their contents. Elevate Energy makes no representation or warranty regarding any other websites or the contents or materials on such websites. Any concerns regarding any such service or resource, or any link thereto, should be directed to the particular service or resource.
  3. GOVERNING LAW. This Agreement and its performance shall be governed by the laws of the state of Illinois, United States of America, without regard to its conflict of law provisions. You consent and submit to the exclusive jurisdiction of the state and federal courts located in Cook County, the state of Illinois, United States of America, in all questions and controversies arising out of your use of this Website and this Agreement.
  4. NO WAIVER. The failure of either party to insist upon or enforce strict performance by the other party of any provision of these Terms and Conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between you and Elevate Energy nor the trade practice shall modify any provision of these Terms and Conditions.
  5. MODIFICATION. Elevate Energy may at any time modify these terms and conditions and your continued use of this Website will be conditioned upon the terms and conditions in force at the time of your use.
  6. ADDITIONAL TERMS. Additional terms and conditions may apply other portions of the Website, and you agree to abide by such other terms and conditions.
  7. SEVERABILITY. These terms and conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.
